Article 1 – Acceptance of the general conditions :
The present general reservation and rental conditions govern the contractual relations between Brittany Cottage and the client, where last mentioned accepts them unreservedly. These general reservation and rental conditions prevail over any other general reservation and rental conditions mentioned on any other document, exception made in the case of prior deliberate and written derogation. The present general reservation and rental conditions are shown and to be read on the site prior to any reservation. Therefore, reserving or requesting a reservation implicates total unreserverdly acceptance of the client of the mentioned general conditions and constitutes the definitive and binding consent of the client of all mentioned clauses.
Article 2 – Contract and term legal regulations :
The rent is seasonal and thus of temporary nature. The lease ceases de facto and de jure at the fixed and agreed expiring date without being forced to expel. The rental period can not be extended without prior written agreement of Brittany Cottage.
Article 3 – Contract extension :
A / Systems of automatic payment and payments by bankcard exclusively :
The systems of automatic registration are considered as valid proof, first, of the choice of the accommodation itself (Villa, Moustoir 1 to Moustoir 5, Mobile-home 1 and Mobile-home 2), second, of the date on which the reservation request has been made, and finally, of the requested rental period (arrival and departure dates).
Under these circumstances the clients commitment is a fact upon receipt by Brittany Cottage of the mentioned automatic registration, by payment of the 25% downpayment of the total amount of the stay, of which the encashment is deferred from 1 to 6 days, paid by bankcard on the secured on-line site "e-transactions" of the "CREDIT AGRICOLE" bank.
During this 1 to 6 days delay, depending on the agreements between banking centers (on-line authorization request to the bank of the bankcardholder) and the availability, Brittany Cottage can validate the payment. Without intervenience of Brittany Cottage, all bank transactions are automatically cancelled on the 6th day by the "CREDIT AGRICOLE" bank.
Article 4 - Contract cancellation :
Any breach of contract by the lessee has to be notified to Brittany Cottage by registered letter with acknowledgement of receipt and will lead to the renunciation of the downpayment by the lessee, and to the recognizance as to the balance to be paid. However, in case of serious matters (illness, accident, decease) which can be proved by official certificates, Brittany Cottage will do anything in its power to rent this accommodation in priority, though without any formal commitment. In any case, the downpayment will be retained as a minimum compensation. If the initial lessee finds a successor offering the same garantees, this new rent will be registered without any charges for the last mentioned party, on approval of Brittany Cottage. We strongly recommend to subscribe a cancellation insurance covering the risks of not being able to respecting ones commitments.
Article 5 - Rental cost and other charges :
The total amount of the accommodation rent, charges and the obligatory deposit are indicated on the website and in the rental contract. The indicated downpayment is due upon reservation and signature of the rental contract. The balance is to be paid to Brittany Cottage one month prior to arrival. The client not paying his balance on time, will be considered as having cancelled his stay. From thereon, the accommodation will be available to rent again, without any refund. The obligatory deposit is to be paid upon arrival at Domaine du Moustoir, as mentioned on the website and in the rental contract. All costs which are not included in the price, should be paid before the departure date. Their amount is calculated as mentioned on the website and in the rental contract.
Article 6 - PRICE - PAYMENTS :
The rental prices are established in Euros.
The price is not submitted to any value added taxes (VAT) except for Moustoir 7 and Moustoir 8 (5,5 % VAT included).
The charges which are to be paid on top of the rental costs, are to be paid before departure and are calculated as mentioned on the website and in the rental contrat.
Payments by bankcard on-line are made by clicking on the CB-icon of the «e-transactions» SECURED PAYMENT WEBSITE OF THE CREDIT AGRICOLE BANK. All payments will be submitted to an on-line authorization of the bankcard owner's bank, whatever the bankcard and the transaction amount. Whatever the outcome of the transaction, the "CREDIT AGRICOLE" bank server always sends to automatic messages by email, one to the client and one to Brittany Cottage. In case of non-acceptance, the reservation request is considered null and void.
Payments can also be made by CHEQUE, POST OFFICE CHEQUE or CERTIFIED CHEQUE, made out in Euros exclusively to the order of BRITTANY COTTAGE. Finally, payments can also be made by bank transfer, but in Euros exclusively.
Attention : payments by bank cheque are only allowed for residents of the Euro zone.
Article 7 - Arrival :
The lessee has to present himself on the exact date and hours mentioned on the rental contract. In case of delayed or late arrival or any other last minute hindrance, the lessee must notify the owner.
Article 8 - Cancellation :
In default of respecting dates of payment or non fulfilment of any clause mentioned in the rental contract, Brittany Cottage can immediately cancel the mentioned contract and expel the lessee during his stay on site.
Article 9 - Interruption of the stay :
Interruption of the stay by the client, will not lead to any refund.
Article 10 - Inventory of fixtures :
An inventory of fixture, guided by an inventory list present in the rented accommodation is done in presence of the lessee and Brittany Cottage upon arrival and upon departure. The cleaning and housekeeping of the accommodation are at the lessees' charge during his stay and before departure.
Article 11 - Deposit :
Before handing over the keys, the lessee has to leave a deposit, a cheque of 300 Euros (except when mentioned otherwise in the contract), made out to Brittany Cottage. This deposit will be returned within maximum 8 days, less any charges needed to cover extra cleaning costs, the obligatory departure cleaning fee, and/or any neccesary repairing costs, in particular concerning furniture and all the electric household appliances.
Article 12 - Use of accommodation and premises :
the lessee should secure the peaceful atmosphere of the accommodation and premises, and, as a responsible family man should, use them correctly himself and survey their correct use by his family. Furthermore, the lessee should respect the estate regulations, under which the sanitary regulations of the swimmingpool.
Article 13 - Capacity :
The present contract is based on a maximum number of persons. Should this maximum be exceeded, then the owner has the right to refuse any additional person. In the maximum number of persons are included «children under 2 years old». A supplementary rental fee can be demanded in case of acceptance of any additional persons. Visitors are not allowed in the swimmingpool.
Article 14 - Animals :
Pets are allowed, except for the Villa, Mobile-home 1 and Mobile-home 2 ; "pets allowed" means 1 dog or 1 cat maximum ; any dog is to be kept constantly on leash. The rental contract specifies wether or not the tenant brings a pet ; Brittany Cottage may turn away any pet if this last cause is not adhered to.
Article 15 - Insurance :
The lessee is responsable for any damage caused by his acts. He has to take out an insurance (with a company known for its solvency) against all risks : theft, fire, damage due to floodings, damage to the accommodation and rent furniture and also against a third party (neighbours etc.).
Article 16 - Lessees' obligations :
Any lost or damaged object present in the accommodation on arrival, should be replaced or refunded by the lessee. This clause also concerns objects such as interior lining, shutters, electric household appliances, rent furniture, blocked up sanitary equipment due to disposal of unadapted objects/products, and any other damage not mentioned here. Moreover, the lessee has to accept any urgents repairings to his accommodation during his stay, knowing that no compensations or reductions whatsoever can be claimed on the rental price. In no case can the lessee rent or assign the accommodation to a third party. He should not make any changes to the furniture arrangements, and even less, take any furniture outside. Any damage or accident should be notified immediately to Brittany Cottage. Deprivation of the use of the swimmingpool due to damage to any of its components, prolonged mechanical failure or any acts of vandalism causing damage to the premises or the swimmingpool (defined in the following article, 17), whether occurring prior to or during the stay of the lessee, does not put the lessee in a position to claim compensations, nor any other of the lessees.
Article 17 - Obligations of Brittany Cottage :
To maintain the accommodation as well as the swimmingpool clean and in good working order, except in the case of force majeure, accidents, natural disasters, and/or in case of vandalism, whoever responsible, identified or not, whether resident of the Domaine du Moustoir or not, perpetrated before or during the stay of the lessee, causing deteriorations or destructions to the premises, the swimmingpool, and, concerning the last mentioned, in particular damage caused to the liner, the electric shutter, the filters, the solar pannels, including the energy/transfer group comprising an auxiliary pump run by solar regulations, and all other essential parts not mentioned here. Finally, Brittany Cottage should ensure the lessee a peaceful stay, and, when possible, remedy any unexpected nuisances.
Article 18 - Claims :
Any claim put forward concerning the non conformity of the accommodation's description and/or the inventory should be notified to Brittany Cottage within maximum 24 hours after having moved into the accommodation.
Article 19 - Nominative informations :
To enable on-line reservation and payment all nominative informations (addresses etc.) are obligatory, these being essential for the treatment of the reservation request, the forwarding of the rental contracts and the preparing of the invoices. When the requested information is incomplete, Brittany Cottage can not validate the reservation. In accordance with french law «data processing and liberties», the treatment of nominative client related data are regulated by a declaration at the "Commission Nationale Informatique et Libertés (CNIL)". The client has the right (article 34, law n° 78-17 of january 6th 1978) to access, modify, rectify and delete all data concerning him, a right which he can exercise with CREDIT AGRICOLE/Brittany Cottage. Furthermore, the "CREDIT AGRICOLE" and Brittany Cottage commit themselves to not communicate, neither for free nor charged, any addresses of their clients to a third party.
Article 20 - ADSL Wi-Fi high debit access :
Following the abovementioned, Brittany Cottage is merely under the obligation to provide the means to enable her clients the access to the mentioned ADSL Wi-Fi high debit service.- For incompatibility or dysfunctioning of a Wireless LAN network card (IEEE 802.11b) with the mentioned Wanadoo Extense Pro mobility service.
- For disturbances or interruptions.
- In case of force majeure decided by the jurisprudence of the Cassation Court.
- The client of Brittany Cottage using the ADSL Wifi access at the « Domaine the Moustoir » abstains from transmitting any data being prohibited, illicit, illegal, contrary to accepted standards of behaviour and law and order and/or undermining or likely to undermine the rights of any third party, especially concerning intellectual, literary and artistic property.
- The client of Brittany Cottage using the ADSL Wi-Fi access at the « Domaine the Moustoir » abstains from consulting, directly or indirectly, any content available on the internet network being likely to hurt the sensibility of minors.
- The client of Brittany Cottage using the ADSL Wifi access at the « Domaine the Moustoir » abstains from accessing and exploring fraudulently, completely or partially, the automatic treatment system of data on the intranet network.
- The client alone of Brittany Cottage using the ADSL Wi-Fi access at the « Domaine the Moustoir » can be held responsible for any prejudice, this being direct or indirect, material or immaterial, caused to a third party by his or her way of using the before mentioned ADSL Wifi service.
Article 21 - Law in force - contract language - attribution of jurisdiction :
The present general reservation and rental conditions are governed by french law. The original language of the present general reservation and rental conditions and the rental contract is the french language. For execution of the present conditions, the parties elect domicile at the offices of Brittany Cottage. In case of a lawsuit or dispute, only the Crown Court of Quimper is competent, without novation nor derogation of this jurisdiction attribution clause.
